Terms & Conditions (User Agreement)

Please read these terms and conditions ("Agreement") carefully. It governs your use of this website ("Site"). By using this Site you, the person using this Site (referred to in this Agreement as "you" or "your" or “user” or “member”) agree with Press Superstore and Superstore Enterprises Ltd and associated companies (referred to in this Agreement as "we", "us" or "our") to be bound by the terms of this Agreement. If you do not accept the terms and conditions contained in this Agreement, you may not use this Site or access or display any of the information made available to you at this Site.

1. Licence to use this Site. We grant to you a non-exclusive, non-transferable licence to use this Site for your own personal use, including:

   1. to display any information; and

   2. to print copies of any information relating to any equipment or services made available on this Site.

2. You may not:

   1. except as expressly agreed by us in writing, use this Site, including any information that you extract from this Site, for any commercial purpose or payment;

   2. except as expressly agreed by us in writing, copy, reproduce, redistribute, download, republish, transmit, display, adapt, alter, create derivative works from or otherwise extract or re-utilise any information made available on this Site, whether for commercial gain or otherwise;

   3. decode nor try to determine the method of representation of any information or service made available on this Site; or

   4. remove any proprietary notices, labels or marks from this Site.

3. Intellectual Property. All rights, including copyright, trade marks, names and logos, used in relation to this Site are owned by or controlled for these purposes by us. Nothing in this Agreement confers on you any licence or right under any or our trade marks, names or logos or those of any third party.

4. No Warranty. You acknowledge that this Site may contain bugs, errors and other problems that could cause systems failures. Consequently, this Site is provided "AS IS", without a warranty of any kind.

5. Accuracy of Content. This site is subject to the honesty and integrity of those that use it. As such Superstore Enterprises Ltd accept no responsibility for the accuracy or truthfulness of the content. All equipment listings are to be used as a guide and facts or information contained on any particular listing should be verified with the person/company providing the information before any agreement or transaction is entered into.
   Superstore Enterprises Ltd reserve the right to remove, without notice, any listings - paid for or free - if it is believed that the content of the listing is in any way false, dishonest, misleading or otherwise deemed to be inappropriate to the nature of the website and its users.

6.  Advertisement of content. Superstore Enterprises Ltd reserve the right to use the content (Images and description) of any or all property listings in order to promote the website via any and all forms of media available. The use of said content will be used with no financial costs to either Superstore Enterprises Ltd or the person(s) creating the listing unless it is done so with prior agreement between Superstore Enterprises Ltd and said advertiser.

7. Payment. All monies paid via this website, or direct to Property Superstore Ltd, by any payment means, are not refundable. Full payment is required at the time of advertisement of machinery or service, whether single, multiple and Dealership Membership adverts or Dealership Membership. In the event of payment is not made, or is declined or charged back, then we reserve the right to immediately remove the advertisement from the site. All refunds and monies provided by Superstore Enterprises Ltd and credited to registered members accounts by way of promotions or favor and are strictly not refundable in cash or otherwise to said members.

8. Advertisements. Each advert is for one piece of equipment only. We will remove the live listing after the paid up period has elapsed. Special rates may be available to re-list equipment prior to the expiry of the paid up advertising period. “Lots” and “complete shops” are not allowed as single advertisements without prior written agreement from Press Superstore Ltd. The advertiser is allowed to edit or modify the listing. However, one advertisement can not be used on a rotational basis for more than one piece of specific equipment. Should a user attempt to advertise more than one piece of equipment in one single advertisement we reserve the right to remove the advertisement and make a charge for the monthly period (for each piece of equipment) that the advertisement was live, even if the advert was removed within 24hours.

9. Dealer membership. A special advertising rate is available to members wishing to advertise one or more machines. The Dealer Membership, is available on a monthly basis, and the full amount is payable regardless of the amount of machines advertised. For the avoidance of doubt if a user who applied for Dealership Membership only advertises one machine, the full dealership monthly fee is payable. Therefore the Dealer Membership is ideally designed for Users with 4 or more pieces of equipment to advertise. Machinery dealers are not restricted to Dealer Membership. Machinery dealers can advertise single machines at the single machine listing fee. However should a User upgrade to Dealership Membership any current live adverts are not refundable or cannot be taken into consideration as prepayment of Dealership Membership fee.

10. Limitation of Liability. You use this site at your own risk. In no event will we be liable to you for any loss or damage of any kind (except personal injury or death resulting from our negligence) including any loss of income, revenue, monies paid as deposit, monies paid for equipment or services, profit, business, contracts, goodwill, data, wasted time or for special, indirect, consequential, incidental or punitive damages howsoever caused.

11. Disclaimer. You acknowledge that the information made available to you on this site is provided by third parties over whom we have no control, in particular in relation to the accuracy or completeness of the data. You agree that we shall not be in any circumstances be liable to you for any loss or damage at all arising from any inaccuracies, faults or omissions in, or in the provision, the information unless caused by our negligence or willful default.

12. Technical Failure. Neither you nor we shall be liable to the other for any failure to perform any obligation due to the failure of any machine, data processing system or transmission link to operate or for any reason beyond your or our control (as the case may be).

13. Modification of Terms. We may, at our sole discretion, change any term of this Agreement by posting a new agreement on our web-site. It is your responsibility to check if changes have been made. Your continued use of the web-site after such changes are posted will constitute your acceptance of the changes to such terms.

14. Modification of web-site. We may, at our sole discretion, terminate, change or suspend any part of our web-site, including any content, features or hours of availability.

15. Offers. Nothing on this web-site shall constitute an offer by us to provide to any person any information or any goods or services.

16. Third Party Rights. Nothing in this Agreement confers on any third party any benefits under the Provisions of the Contracts (Rights of Third Parties) Act 1999.

17. Severance. If any part of this Agreement is found to be void or unenforceable, it will be severed from the rest of this Agreement so that it is ineffective to the extent that it shall not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms.

18. General. We strongly recommend that a User satisfies themselves through a process of due diligence prior to agreeing to buy or pay for any equipment or service advertised on this site.

19. Entire Agreement. This Agreement records the entire agreement between you and us. Nothing in this clause shall affect the liability of either party in respect of any misrepresentation which it makes fraudulently.

20. Governing Law. This Agreement is made under and will be governed by the laws of England. You and we hereby submit to the non-exclusive jurisdiction of the English Courts.
